Planning, zoning commission approves comprehensive plan

Ellis County Planning and Zoning commissioners, after reviewing several amendments to the Ellis County comprehensive plan, approved the plan at their Wednesday night meeting.
Commissioners met for an educational session prior to the regular meeting and discussed organizational bylaws and implications of approving the comprehensive plan.
Dale Wing, Ellis County environmental/planning and zoning manager who facilitated the session, said the time was set aside to answer questions commissioners might have regarding county zoning regulations and the comprehensive plan.
Commission Chairman Kendall Krug questioned County Counselor Bill Jeter regarding whether he has seen legal action generated against comprehensive plans in other counties.
"The plan in and of itself is not a legally enforceable document," Jeter said. "Zoning regulations are, but a comprehensive plan is not.
"You adopt zoning regulations that follow the guidelines of the comprehensive plan."
The next step for the comprehensive plan, which has been in the works for approximately a year and a half, will be its consideration by Ellis County commissioners at the regular meeting Monday, according to County Administrator Greg Sund.
In other business, Wing presented commissioners with a conditional-use permit application from Chicago-based Invenergy Wind Energy LLC to build an additional meteorological tower on the east side of Hyacinth Avenue between Buckeye and Severin roads.
Permission to grant Buckeye Wind Energy LLC, wholly-owned subsidiary of Invenergy, the right to file the conditional-use permit application was signed by trustee of Stackhouse Trust, George R. Joy.
Invenergy has long-term lease agreements in place with Ellis County landowners for wind development in northern Ellis County.
A public hearing on the conditional-use permit will be at the Oct. 24 planning and zoning commission meeting.
"Everything seems to be in order," Wing told commissioners of the application. "If you find anything deficient, we'll need to address it when we have our public hearing next month."
