TOPEKA — The legal battle over the construction of two coal-fired power plants in southwest Kansas will now expand to federal court.

Hays-based Sunflower Electric Power Corp. filed a lawsuit Monday in U.S. District Court against Kansas Gov. Kathleen Sebelius, Lt. Gov. Mark Parkinson and Health and Environment Secretary Rod Bremby.

The suit claims those executive branch officials have violated Sunflower's right to fair and equal treatment under the law and are unlawfully prohibiting interstate commerce.

Sunflower is asking that the officials be stopped from preventing Sunflower's plans to construct to two 700 megawatt coal-fired generators near Holcomb.

funny the subject of that comment should be "ignorance." As far as this story says, Sunflower doesn't appear to be asking for money, just some legal directive allowing them to build their legitimate power plants. And the law in the STATE is irrelevent in the suit -- they're suing in federal court. Thanks for the laugh!

It is amazing how little the public knows about what electric utilities must go through to provide electricity to them. It would be nice if utilities could provide only to those who really want their product instead of having to provide to the ignorant as well.

I can't believe how arrgonat Sunflower really is they are looking by suing someone for free handouts, just like the people that get burnt by hot coffe at Mcdonanlds.Their overly paid Management staff must not have anything better to do than dreams ways of bilking the working public for free handouts, just like people on welfare that are to lazy to work, maybe they have not noticed that the country is struggling right now, or are their manager just to arrogant to care about the little people. I for one am little tired of companies and their management staff living off free handouts. I hope the law in this great STATE sides with the goverment
