Bust nets 7 arrests

The Department of Justice, in conjunction with the Ellis County Sheriff's office, announced Wednesday the indictment of six men and a woman from Hays on federal drug trafficking charges.
Named in the 21-count indictment were Rigoberto Rubios, 24; Rusty "Ben" Marshall, 27; Thomas J. "T.J." Matheny, 19; Dylan Motta, 22; Keaton M. Molleker, 19; Franklin L. Graton, 20; and Angela Marie Alvarez, 27.
The indictment alleges that from about April 1 to June 30, Rubios, Marshall, Matheny and Motta conspired to distribute methamphetamine. Related counts allege that throughout May and June, those four men distributed various amounts of meth.
The second conspiracy charge alleges that from about April 1 to Oct. 31, all but Alvarez conspired to distribute cocaine and subsequently distributed the drug throughout that same time frame. Other charges include possession with the intent to sell either drug.
If convicted, the crimes carry severe penalties.
A conviction of conspiracy to distribute methamphetamine results in a minimum 10-year prison term and a possible $4 million fine. The maximum penalty is life in prison.
A meth distribution conviction could net a five- to 40-year sentence and $2 million fine for each count.
Similar cocaine charges carry maximum penalties of 20 years and fines of up to $1 million.
Additionally, conviction of any of the charges could force the defendants to forfeit "any and all property constituting or derived from, proceeds obtained, directly or indirectly, as a result of the said violations and any property used, or intended to be used, in any manner or part, to commit, or to facilitate the commission of the said violations," the indictment states.
Such proceeds include more than $11,000 acquired on dates in July and September.
Sheriff Ed Harbin this morning said five other, unnamed people have charges pending.
Harbin said 12 arrests were made Wednesday as he and other local, state and federal officers executed five search warrants at locations throughout the city.
Although he could not yet elaborate further on the ongoing investigation, he did indicate that police activity at the Main Street 66 auto repair shop and at a garage behind an apartment complex located in the 300 block of East Fifth Street was related to the case.
Wednesday's activity was the culmination of an eight-month investigation led by the Ellis County Drug Enforcement Unit, a joint city, county and state task force unit.
According to Harbin, 73 officers from nine different departments were involved in the bust, including two special tactics teams made up of members of the Ellis, Russell and Lincoln county sheriff's offices, Hays and Garden City police, Kansas Highway Patrol, Kansas Bureau of Investigation, Alcoholic Beverage Control and a Drug Enforcement Agency unit out of Garden City.
Harbin said further details were not available, as not all reports had been turned in.
"We're still going, trying to get everything figured out," he said.

People dont even really know the whole story you only hear the stuff the news and the cops say. The people i know that were involved in this are good people and wouldnt' hurt anyone they did what they had to do to provide for their children, don't judge some one untill you walk a mile in their shoes and i'm sure about 85% of the adults and teens in Hays do some type of drug probably some of your children. Their not the "BAD GUYS" untill they get caught, not when people are taking the drugs, and their are so many people there that do drugs some one else is going to com along and start selling.And to the people that said "Alvarez" needs to be in jail have u ever thought she was around those people because on is the father of her child . also to post a comment it says"All comments are subject to approval before being posted. Pregnent or not she knew what she was doing. PAY THE PRICE. Some of these dont need to get life----what about these people that kill someone and only get 10-15 yrs. come on they should be the ones with life. Or do the same to them as they did to the victim. I dont beleive in drugs but come on think about it what would you sooner have on the streets? Drugs or having to watch your back every step.

I have read all of the comments that have been posted, and quite honestly...I am some of the comments make no sense at all and othrs seem as if they are coming from someone that aggree with drug distribution. I guess I just dont get it...There are laws that have been set for the good of all mankind and these laws have been breached. So I guess my question is...How can anyone feel sorry for someone that has willingly broken the law. I cant believe they didnt know what they were doing. Many of the comments state that they know one or more of the persons involved. Well, so do I, but that doesnt mean that I can agree with what was done. Drugs are bad no matter what you may think. One person states that the problem is the users...Well, I guess I disagree... If the drugs were not brought to this town then maybe the user wouldnt get them here would thy. You say they would find out how to get them...sure thy would...but maybe they would move out of our town making one less drug user. And for the one bringing the drugs to our town, getem outta here...Innocent children not intrduced to drugs will not use them. If the drugs are not present then...well lets see if your smart enough to figure out the rest of the sentence...Laws are laws...decisions are decisions...so if these people made the decision to break the laws then they should be prosecuted accordinly no matter is thy have children or are pregnant or what ever the situation may be...

It is so hard to believe some of the stuff I just read on here. Come on people didn't your parents teach you anything about drugs!!! No matter what if these people broke the law and chose to do what they did they knew they were in the wrong! DUH!! I'm a mother and I chose to make a living for my family the good old fashion way and know that I would never want that kind of crap in my family. So think about it that's why we make these kind of laws to keep this stuff off the streets and out of the hands of our loved ones!!! WOW!! COME ON PEOPLE!!

I know one of the accused and his family VERY well. And let me just say that I can gurantee that I know the household he was raised in. It was a place where in was taught that drugs are will get you nowhere. Guess what -he made a mistake! Who hasn't? This young man being accused is one of the nicest and funniest people you will ever meet! And he has a VERY big heart!!! It is hard to believe and accept that he could actually be guilty of this but if he is then he will take this as a learning lesson. Something he will grow from and if he is ever in a similar situation that could get him in trouble he will have the maturity to walk away because of what he is going through now! I feel for his family because I know they are completely heart broken and shocked - they NEVER expected to be facing something like this with him. And I hope they know that why some people think these "kids" get the most severe punishment possible that some of us have hearts and have made mistakes in the past and it is the only way we learn and grow.

Each and everyone of the arrested and accused are innocent until proven guilty, none of which have even been to court some have not even had a hearing yet!! Let's leave them innocent until a jury of their peers finds otherwise. If you aren't a juror in the case then it's not your call!!

i know the situation first hand. many of you don't. please don't comment on what people should get or that it doesn't matter the holidays are coming up or anything like that if you dont know the situation. these comments can come across as very insensitive and honestly none of you who don't know the situation firsthand should feel the need to voice an opinion on what their sentences should be or anything else regarding the situation.

Life in prison? Are you nuts? You don't have kids do you? Each one of these kids belongs to someone and were probably raised with the beleif that drugs get you nowhere. However, people do make mistakes - it is how people learn. Unfortunately there are people like you who don't believe that deserve a second chance. Instead of life in prison why don't they get put in a rehad facility? I can see doing time - for those who are guilty - but life? Get serious! You can honestly say that if one of these kids was your son or daughter you would want her to spend life in prison!!!

i think alot of these comments are from hypocrittcal people. who are you to pass judgment on them and theior families when you dont knwothe root of the problems, you dont them, nor their families. it is possible to live 2 different lives and in some cases maybe they loved their families enough to not tell them or even hint anything about their doings. angela is pregnant and has 2 jobs, shes a busy mom of 3 and a hays resident with no priors and i know has a good heart. i know one of thems wife and children and she is one of the most generous people i know and always puts her family first. i think both women are great mothers and i can see how controlling men could lie and be so decieving. i on the other hand say dont pass judgment onto others- we will all be judged no our day and what will you be jugded for? you dont know these people nor their families. you can agree or we can agree to disagree, this is just my opinion.

While all of this is not surprising that it is happening, what is surprising to me is that some people ACTUALLY think these people are innocent and should not be prosecuted. These people knew EXACTLY what they were doing and that it was, and ALWAYS WILL BE, wrong and illegal. That fact alone should make them accountable. There are many people making an honest living the old fashioned way by working, and I know that they are glad to see this war on drugs, albeit only a start, to ensure that our children and grandchildren have a safe and wonderful place to live, play, and grow up in. After all, that is what make Hays, and Western Kansas, such a GREAT place to work, play, and live!!!

who cares if the holidays are just around the corner....? People that have figured out how to make or obtain an illegal drug such as meth know what they are doing and should be punished. Plus, if they are doing meth then they wont care about holidays much longer because they'll become all messed up and purely driven by a nasty addiction. Ive seen firsthand what meth can do to people and whatever sentence these people get, they deserve it.

They must of had plenty of evidence if they have been doing investigation for 8 months, plus they had federal people on hand. I don't care if the person doing this was God. They all deserve very harsh punishment. If Alvarez is 5 months pregnant what on earth is she doing around those people and putting her baby and herself at risk? She should be put in jail for pulling a move like that! As far as the others they should get life in prison. The more drug dealers, users & traffickers they put in jail for life the less there will be on the streets. Kudos to the Ellis County Law Enforcement and everyone else who was in on this bust. It was a job well done!

it was no coincidence that this happened it was comin to them, 9 months of investigation, they were jus waiting for the best time to make the bust, so they could get all of them instead of one at a time its nice to know they main dealers of hays are behind bars

It sounds like you are suggesting that it is ok for these drug dealers to go on with their everyday routines of profiting from everybody's addiction and disease. This is not ok by any means. Addicts will spend their last dollar on these drugs and the dealers will take it time and time again. I've been down that road and have recovered from this destructive behavior. These people need to be held accountable like I was and move on with their lives and stop assisting in the destruction of other peoples lives. Profiting from other peoples sickness is far from ok. Treatment is where the ones that wish to recover should be placed and the ones that don't want a better life should be incarcerated.

Guilty or Not, we will see. Its all about the company you keep. You may not be doing anything but if you're hanging out with people who are you are going to get in trouble. Life is about making decisions and they didn't make very good ones. I used to coach one of these kids and I feel bad for him but he made some bad decisions.

I'm glad for their hard work. I hope they keep it up and declare constant war on drug suppliers because other dogs are moving in to take their place. We also need to do our best as a community to keep the demand low by convincing our kids of the dangers and by getting all the help we can to those adults who want to quit. Drugs ruin our communities, our society. Next we need to spread the efforts outside of Hays to the small towns. Drug activities have gone on unbridled for years until recent police efforts. Keep up the good work! Let's keep up a war that let's the dealers know they can't deal anywhere near here.

I thought the originallity of cops being formed were to serve and protect but as everything changes. All I see from them now in todays society is harrassment and bullying, I'm not trying to be rude or slanderous I am just stating my opinion. Whether you agree or disagree is up to you, but read the lines I know we've all made our own mistakes, it is something we should all be held accoutable for under the right context. But seriously who gives these men the right to judge other men. We we're created by a higher power and man has tarnished our very own creator since the time of birth, all I am saying is who is the judicial system to judge these men/women?

When is Kansas (and furthermore the U.S. at large) going to learn that stopping drug use is a battle that's fought with drug users, not drug traffickers. Sure, this bust will rid the Ellis, Hays, and Russell streets of Methamphetamine and Cocaine for a short while, but they will come back again very soon (if they ever leave). If the people want drugs, they will find ways to get them. Wake up Kansas Law Enforcement.

not everything mentioned on this is true. I dont think the police had enough evidence to have made those arrests. As far as Angela Alvarez goes-- she is a good women who is currently 5 months pregnant. how can they have put someone like that in jail?!!
