Couple bound over on charges

An Ellis County couple will stand trial on a series of sex crimes against a child, including a new charge filed against each of them Wednesday at their preliminary hearing.

Nyla Juanita Thomas, 32, and Andrew Paul Thomas, 34, both were bound over Wednesday by District Judge Tom Toepfer in Ellis County District Court, according to Ellis County Attorney Tom Drees.

With an additional charge, Nyla Thomas now faces three felony counts of aggravated criminal sodomy involving a juvenile male. Paul Thomas faces three counts of solicitation to commit aggravated criminal sodomy.

The new charge was added at the request of Drees, after the victim testified about a third incident.

Previously, the charges had indicated the incidents had taken place in 2008 and 2009. Wednesday's testimony indicated there was another one, in 2010, Drees said. The first two charges were filed Nov. 14, with the latest added at the conclusion of Wednesday's hearing.

All three charges are considered off-grid felonies with a presumed sentence of life in prison with a mandatory minimum prison term of not less than 25 years.

Nyla and Andrew Thomas remain in the Ellis County jail in lieu of $50,000 bond each.
