You are hereby notified that a petition has been filed in the District Court of Ellis County, Kansas, by Equity Bank praying for foreclosure of mortgage and to quiet title on the real property legally described as follows:

The North Forty-nine Acres (N 49 A.) of the Southwest Quarter (SW/4) of Section Thirty-four (34), Township Thirteen (13) South, Range Seventeen (17) West of the 6th P.M., Ellis County, Kansas

AND

The South Half of the Northwest Quarter (S/2 NW/4) of Section Thirty-Four (34), Township Thirteen (13) South, Range Seventeen (17) West of 6th P.M. Ellis County, Kansas Except the Following Described Tracts:

Beginning at a point on the West line 288.2 feet North of the Southwest corner of the Northwest Quarter of said section; thence North 01 degrees 34 minutes East along said West line 286.2 feet; thence North 86 degrees 24 minutes East 1189.6 feet; thence North 89 degrees 39 minutes East 440.7 feet; thence North 76 degrees 29 minutes East 203.0 feet; thence North 86 degrees 24 minutes East 500.0 feet; thence North 89 degrees 41 minutes East 174.3 feet; thence on a curve of 7789.44 feet radius to the right with a chord which bears North 86 degrees 56 minutes East to a point of the East line 761.8 feet North of the Southeast corner of said quarter sections; thence South 01 degrees, 29 minutes West along said East line 283.1 feet; thence South 85 degrees 36 minutes West 120.4 feet; thence South 89 degrees 41 minutes West 174.3 feet; thence South 82 degrees 04 minutes West 331.0 feet; thence South 88 degrees 43 minutes West 370.3 feet; thence South 86 degrees 24 minutes West to the place of beginning.

Commencing at the Iron Bar marking the Southwest corner of the Northwest Quarter (NW/4) of said Section Thirty-four (34); thence North along the West line of said Northwest Quarter, a distance of 579.22 feet to the North right-of-way of I-70 Highway for a point of beginning; thence Easterly along said right-of-way a distance of 522.20 feet; thence North parallel with the said West line of said Northwest Quarter, a distance of 617.23 feet; thence Southwesterly a distance of 505.04 feet to a point on the said West line of said Northwest Quarter 739.75 feet North of the point of beginning; thence South along said West line a distance of 739.75 feet to the point of beginning

commonly known as 1334 310th Ave., Hays, Kansas 67601, together with all minerals, oil, gas and geothermal rights, royalties, and profits relating to the real property, subject to recorded interests; and you are hereby required to plead to the petition on or before May 30, 2017, in the District Court of Ellis County, Kansas. If you fail to plead, judgment and decree will be entered upon the petition.
