ORDINANCE NO. 3928

AN ORDINANCE AMENDING CHAPTER 14 , ARTICLE II OF THE CITY OF HAYS, KANSAS, MUNICIPAL CODE, BY MODIFYING SECTIONS 14-58(6) AND 14-117 TO AUTHORIZE SUNDAY SALES OF ALCOHOLIC LIQUOR AND CEREAL MALT BEVERAGES IN THE ORIGINAL PACKAGE WITHIN THE CITY OF HAYS.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF HAYS, KANSAS:

Section 1. Chapter 14, Article II, Division 2, Section 14-58, Paragraph (6), of the City of Hays, Kansas Municipal Code is hereby amended as follows:

(6) Pursuant to K.S.A. 41-2911(b)(1)(A), as amended, the sale at retail of cereal malt beverage in the original package is allowed within the city on any day between the hours of 9:00 a.m. and 11:00 p.m., including any Sunday, except Easter, between the hours of 12:00 noon and 8:00 p.m., and including and including Memorial Day, Independence Day, and Labor Day. Closing hours for clubs shall conform to K.S.A. 41-2614 and any amendments to it.

Section 2. Chapter 14, Article II, Division 4, Section 14-117, of the City of Hays, Kansas Municipal Code is hereby amended as follows:

Sec. 14-117.-Hours of retail sale regulated.

Pursuant to K.S.A. 41-2911(b)(1)(A), as amended, the sale at retail of alcoholic liquor in the original package is allowed within the city on any day between the hours of 9:00 a.m. and 11:00 p.m., including any Sunday, except Easter, between the hours of 12:00 noon and 8:00 p.m., and including Memorial Day, Independence Day, and Labor Day.

Section 3. This ordinance shall be published once each week for two consecutive weeks in The Hays Daily News, the official city newspaper.

Section 5. The ordinance shall take effect and be in force 61 days after the final date of publication in The Hays Daily News, the official city newspaper, or on the 8th day of April, 2017, whichever is later, unless a sufficient petition for a referendum is filed, requiring a referendum to be held on the ordinance as provided in K.S.A. 41-2911(b)(1)(B), in which case this ordinance shall become effective upon approval by a majority of the electors voting thereon.
