Signs posted on the doors of JT Travel Plaza, 1130 E. 41st, confirm the business has been closed due to a mortgage foreclosure lawsuit pending in Ellis County District Court.
The business housed a gas station/convenience store, as well as a Schlotzky’s and Cinnabon franchise. It opened in November 2016.
The petition was filed Wednesday against the business’ owner, Michael D. Weilert, with several other defendants listed: JT Travel Plaza LLC, Weilert Oil Co. Inc., Astra Bank, Midcountry Equipment Finance, Vend-Lease Co., Amcon Distributing Co. and State of Kansas Department of Revenue.
The plaintiff is Central National Bank. According to court documents, JT Travel Plaza is indebted to that bank for two commercial promissory notes at an aggregate amount of $2.4 million.
Personal property collateral is estimated at $140,000, and Judge Glenn Braun ordered a bond for delivery of personal property collateral Wednesday for double that amount.
Braun also ordered a restraining order to be issued Wednesday against JT Travel Plaza and all defendants, per Central National Bank’s motion.
The bank also filed a motion Thursday morning that would allow the bank to secure the property and conduct inventory.
