GREAT BEND - The Barton County Sheriff's Department has concluded the initial investigation of an incident aboard a Great Bend USD 428 school bus carrying the Great Bend High School boys swim team Feb. 3 and found that the following crimes occurred:

- aggravated criminal sodomy

- battery

- criminal restraint

The investigation identified one victim, age 15, and one suspect, age 17. Both are students at Great Bend High School. The names were not released.

The suspect was not taken into custody, according to Sheriff Brian Bellendir. That decision rests with Barton County Attorney Douglas Matthews, Bellendir said. 

The case was given to the Matthews' offfice late Monday. Although the Barton County Sheriff's Department thinks evidence supports the above crimes, the final charging decision is up to the Barton County Attorney, the press release from Bellendir said.

It will take the county attorney some time to review all the documents involved, the release said.

Through various methods of investigation and numerous interviews, Bellendir's department determined the crimes occurred on Northeast 30 Road in Barton County between 8:30 and 8:50 p.m. Feb. 3.

Ellsworth County authorities investigated a Feb. 6 incident carrying the Great Bend High School boys swim team on the bus when it traveled through Ellsworth County. The Ellsworth County attorney has not filed charges at this point.
