A Hays man facing a rape charge entered an Alford plea Monday in Ellis County District Court. Jordan Burgess pled no contest to one count of aggravated reckless battery, causing great bodily harm, a level five, person felony.

He also pled to three counts of sexual battery, class A misdemeanors that require 15-year sexual offender registration.

Burgess will return to court for sentencing May 1. 

The underlying sentence for the felony aggravated battery charge is 36 months border box. The plea agreement is recommending three years of probation with Northwest Kansas Community Corrections in lieu of prison.

Burgess also might be responsible for restitution.

Burgess was arrested in late October of 2016 on suspicion of rape.


Clarification: The Alford plea entered Monday in district court is recommending three years' probation in lieu of jail time. Sentencing will not be until May 1.
